Diva Kakes & More is an online custom-order bakery and event dessert service offering custom cakes, cupcakes, cake pops, dessert tables, party favors, event décor, and related services. At this time, Diva Kakes & More operates as an online custom-order business and does not offer walk-in retail shopping.

2. Acceptance of Terms

By using this website, submitting an inquiry, placing an order, or making payment, you acknowledge that you have read, understood, and agreed to these Terms of Service, along with our policies, FAQs, and applicable payment terms. If you do not agree with these terms, please do not use our services.

3. Order Requests & Booking

Submitting an inquiry form does not guarantee availability or confirm an order. Orders are only confirmed when:

availability has been approved
retainer fee or required payment has been received
required agreements have been completed
confirmation has been issued by Diva Kakes & More

Diva Kakes & More reserves the right to decline any order request at its discretion.

4. Pricing & Payment

Prices are subject to change without notice.Quotes provided are valid for the timeframe stated in the quote. A Non-refundable retainer fee may be required to secure an event date. Final balances must be paid by the due date communicated during booking. Failure to complete payment may result in cancellation of the order.

5. Retainer Fees & Refunds

Retainer Fees are Non-refundable unless otherwise stated in writing. Because custom desserts and event services involve scheduling, preparation, labor, and perishable ingredients, refunds are generally not provided once work has begun. Refund requests related to extraordinary circumstances will be reviewed at Diva Kakes & More’s discretion.

6. Custom Designs

Diva Kakes & More specializes in custom creations.Inspiration images are accepted for design reference only.Exact duplication of another designer’s or baker’s work is not guaranteed.Minor artistic interpretation, design adjustments, and handcrafted variations may occur.

7. Allergy Disclaimer

Products may contain or come into contact with:

eggs
wheat
soy
peanuts
tree nuts
gluten

Customers are responsible for disclosing allergy concerns prior to ordering. Diva Kakes & More does not guarantee an allergen-free environment unless specifically stated. Consumption is at the customer’s own discretion and risk.

8. Pick Up Policy

Pickup is by scheduled appointment only. Customers are responsible for arriving at the agreed pickup time. Once an order has been picked up and accepted, responsibility for safe transportation, storage, and handling transfers to the customer. Diva Kakes & More is not responsible for damage occurring after pickup.

9. Delivery Policy

Delivery may be available for select orders for an additional fee. Delivery pricing may vary based on:

setup requirements
order size
event timing

Once delivery is completed and accepted by the customer, venue representative, or designated recipient, responsibility transfers to the receiving party.

10. Event Setup Services

Dessert table setup, event décor, balloon styling, and related services may require additional coordination, access timing, and fees.Customers are responsible for ensuring venue access, setup permissions, and accurate event details.Delays caused by venue restrictions or customer scheduling issues may impact services.

11. Order Changes

Change requests must be submitted within the timeframe communicated at booking. Approval of changes is not guaranteed. Additional charges may apply for:

rush modifications
design upgrades
quantity increases
location changes
service expansions

12. Cancellations

Customer cancellations do not guarantee refunds.Deposits remain non-refundable.Additional cancellation terms may apply depending on production stage, materials purchased, or event commitments.

13. Unforeseen Circumstances / Force Majeure

Diva Kakes & More shall not be held liable for delays, interruptions, or inability to perform due to circumstances beyond reasonable control, including but not limited to:

severe weather
natural disaster
sillnes
sfamily emergencies
equipment failure
supply shortages
transportation disruptions
power outages
venue access restrictions
acts of God

In such cases, reasonable efforts will be made to communicate options including rescheduling or alternate arrangements where feasible.

14. Product Care

Customers are responsible for following all storage, transportation, and handling instructions. Diva Kakes & More is not responsible for damage caused by:

improper storage
excessive heat
outdoor exposure
mishandling
delayed pickup
customer transport accidents

15. Intellectual Property

All website content, branding, logos, graphics, text, photos, and design materials are the property of Diva Kakes & More unless otherwise noted. Unauthorized reproduction, copying, or use is prohibited.

16. Photography & Marketing
